On the afternoon of November 18th, the victim Brenda had exited a Foodland and was crossing Bank Street westbound. The accused, Matthew, was driving southbound on Bank Street when he struck the victim when she was approximately half way across the southbound lane. A mechanical inspection found multiple issues with the vehicle, determining it should not have been on the road. It was also noted that there was no evidence of braking or evasive manoeuvres before the collision. The victim suffered extensive injuries and was pronounced dead at the scene. Matthew was charged with careless driving causing death.

Result: This was an extensive process with lots of negotiation. While the client was not speeding and seemed to be driving normally, the state of his vehicle was so bad that it was felt that this in itself made him careless. Client was willing to plead guilty to careless driving causing death. After completing a remedial driving course, he received a fine of $2,000 and for the first six months, could only drive to and from work.
