One evening, Rideau Lakes OPP were contacted regarding a string of traffic complaints originating from Frontenac OPP involving a vehicle speeding, braking and crossing lanes erratically. When stopped by police, Alana was identified and admitted to being the driver in question. Police noted a smell of beer, and that Alana was unsteady on her feet. At the police station, police obtained breath samples with readings of 210 and 190.
Outcome: There were weaknesses in the Crown’s case regarding the timing of the breath demand. The Crown recognized this and agreed to a guilty plea to careless driving instead of impaired driving. As a result, Alana avoided a criminal record (and immigration consequences) and had no further driving suspension.
