Thomas is the uncle of the victim Jen, and the adoptive brother of Jen’s mother. Between February 20, 2014 and February 19, 2020, Thomas was accused of sexually assaulting Jen while she was at her grandmother’s residence. Thomas would ask Jen to play the ‘bum’ game and take her pants down. While she was under a blanket, Thomas would touch her private parts, and she was made to touch his penis, which he would also pull out and ask her to lick it. The incidents started when Jen was around 5 years old, and she started to realize what was happening when she was around 10 years old, and recalls Thomas taking pictures of her private area and being scared. During part of the period of the incidents involved, Thomas was under 18 years old. As a result, Thomas faced charges of sexual assault, invitation to sexual touching, and invitation for sexual purpose, both as an adult and as a youth.
Outcome: Although convicted after trial, the trial judge imposed a sentence of only three years, which is at the low end of the sentencing range for sexual offences against children.
