Stephen and Sara were in a relationship. In the early hours of March 21st, Sara returned to Stephen’s residence with some friends after an evening celebrating her birthday. He became upset and began yelling, and Sara attempted to calm him. Without warning, Stephen punched Sara in the mouth, causing her lip to bleed, at which point she left with her friends.

Approximately 10-20 minutes later, Sara returned to retrieve her cell phone, and Stephen grabbed her by the hair, swinging her around the kitchen. He punched her on the mouth again, causing her upper lip to split and pour blood, as well as causing swelling. Sara then fled the residence and called 911. She did not provide a statement, but responding police did observe her injuries.

Stephen was charged with three counts of assault.

Result: We received new sworn statements (affidavits) from Sara and her friend denying any criminal activity took place. Despite this, the Crown refused to withdraw the charges. The client could not afford to retain us for trial and chose to represent himself.
