Shortly after 1am on July 14th, military police in Petawawa received a call regarding a domestic dispute involving Sandra and Samuel. Upon arriving at the scene, MP’s interviewed the couple separately. It was determined that during the night, Samuel had moved from the couple’s shared bed to a living room couch. Sandra followed to speak with him but received no response. Upon returning to the bedroom, Sandra began sending Samuel texts to clarify why he left the bedroom. This irritated Samuel, who began yelling and threw a glass, then pushed Sandra in a further altercation. A later interview revealed that a television remote control was also broken during the incident.

Samuel was arrested and charged with assault and two counts of mischief under $5000.

Result: The criminal process took many months and the two spouses were forcedly separated during this time. Both wanted to resume their relationship. Sandra had provided a recanting affidavit calling into question her original allegation. The Crown, recognizing weakness in its case, agreed to an 810 peace bond for Mr. Mendez, but only after we filed a motion to vary the bail terms (with a view to getting the spouses back living together while the case continued). Upon entering the peace bond, the criminal charges against Mr. Mendez were withdrawn.
