At approximately 11:45am on May 4th, Hello Fresh delivered a food box for building resident Sharon Ashton. Per Sharon’s instructions, the box was left in the building’s vestibule area. Roughly 10 minutes later, Lucy Stone entered the building. She was then seen on surveillance entering the building lobby with the package address to Sharon. One minute later, Lucy entered the elevator with the package and returned to her unit.
After Hello Fresh confirmed only one package was delivered to the building, and video surveillance was obtained, Lucy was charged with one count of theft under $5000, and released on an undertaking.
Result: While it was not possible to determine the addressee on the package, the objective improbability that it was another person’s package was irresistible. Therefore, resolution was the focus. Ultimately, the Crown agreed to divert the matter (withdrew the charge after doing some community service). Lucy avoided a guilty plea and a criminal record.
