Larry and Samantha had been in a relationship for 5 years. Each had two children from previous relationships, and one child in common. One day, Larry was returning their child to Samantha and an argument broke out. He was charged with uttering threats and the police added more charges after Wendy went in to give a statement. Overall, Larry faced six charges, including assault and assault by choking.
Outcome: At trial, the defence was able to demonstrate that there were serious concerns about the complainant’s credibility. As a result, Larry was acquitted of everything but the mischief.* He received a conditional discharge with three years’ probation and a restitution order.
*This finding of guilt is currently under appeal.
