Late in the evening of July 31st, Maybel Hinchley was with Logan Johnson in the garage of his parents’ home. After having consumed marijuana with Logan, Maybel was laying on the bed when Logan took her face in his hands and kissed her on the lips. When told she was leaving, Logan proceeded to push her back onto the bed, straddled over her body, and pinned her arms above her head. Only after Maybel demanded he get off her did Logan let up some of his weight. She had to push him out of the way before being allowed to leave. Several months later the incident was reported to police.
Result: This matter went to trial after all attempts to negotiate a resolution failed. Logan was acquitted of assault in large part because Ms. Hinchley had testified that the reason she came forward was to “have the back” of the complainant in Logan’s other file. The judge was concerned about possible collusion since there were no other corroborating features of the complainant’s testimony.
