In July 2021, an SUV was involved in a single vehicle collision with a metal causeway. Upon arriving at the scene, police interacted with Gerald, who was observed to have slurred speech, a lack of concentration, and had a hard time focusing. Based on this, the officer had reason to believe that Gerald was impaired.
After being read his rights and transported to custody, Gerald spoke with his lawyer. Approximately 90 minutes after the initial call to police, a breath test was administered and provided a reading of .210. After attending the hospital at his own request, Gerald was charged with impaired over 80, and released on an undertaking.
Results: Gerald entered a guilty plea. A $3,000 fine was imposed, plus a $900 Victim Fine Surcharge and a 1 year driving prohibition.
