Aaron was completing some last minute Christmas shopping. On the drive home from the store, he was stopped by police for suspected driving while intoxicated. During the stop, several attempts were made by the officer to obtain a breath sample. All attempts failed. Aaron was charged with failure to provide a breath sample.
Result: During a one day trial, it was argued that Aaron was compliant, and made good-faith efforts to provide a breath sample. The Crown was unable to demonstrate otherwise. As a result, Aaron was acquitted.
