On December 18, 2024, Liam* was assaulted at the Crazy Horse Bar in Ottawa. While socializing with friends, he was approached and punched in the face by the accused, Kerry Barton, after confirming his name. She was removed by security.
At approximately 11:45 p.m., after the victim stepped outside, James sucker punched him, causing him to fall. James and Randy continued the assault until security intervened. James fled, and Randy was removed by staff.
While Liam was receiving first aid inside the bar, Kerry returned and recorded him with her cellphone.
Kerry was arrested on December 30, 2024, and during a custodial interview, made incriminating statements, admitting to the assault and identifying her co-accused.
As a result, our client was charged with assault, assault causing bodily harm, and conspiracy to commit indictable offence.
Result: The client chose to plead guilty to assault. She was from a good family and was in school. She also worked a multitude of part-time jobs and obtained rave reviews. The Crown sought a criminal record (suspended sentence) while we sought a conditional discharge. She received the latter and avoided a criminal record.
