On a December afternoon, Jennifer was driving eastbound on County Road 17. Witnesses in a following car contacted police to report a vehicle with a possible impaired driver swerving all over the road, unable to maintain speed, and coming to a complete stop for no apparent reason. Jennifer pulled into a Walmart parking lot and was unresponsive to one of the witnesses knocking on her car window.

When police arrived, the witness identified Jennifer as an individual entering the store. Officers approached Jennifer, and observed she had a hard time standing, seemed incoherent, laughed at inappropriate times, and smelled of an alcoholic beverage. She was arrested on scene for impaired operation. At the police station, two breath samples were provided, both with readings of .200.

Result: Despite recommending that she go to trial because of Charter violations, Jennifer decided to plead guilty to impaired driving in L’Orignal, Ontario. She received a $2,000 fine and a 12-month driving prohibition. She engaged in outpatient rehabilitation and had strong prospects of never seeing the inside of a courtroom ever again.
