On December 27th, police responded to a collision involving an impaired driver. At the scene, multiple witnesses indicated that the driver, identified as Eric Stanfield, was driving southbound, failed to stop for a red light, and struck an eastbound vehicle, causing it to spin and strike a third vehicle. While speaking with police, Eric admitted to failing to stop for a red light. During the conversation, police noted indications of impairment, and seized empty cannabis/THC packages. Eric was transported to a hospital and subsequently charged with dangerous operation of a motor vehicle while impaired by drugs.
Outcome: The client was not impaired but rather mentally ill. We sought an not criminally responsible diagnosis from a doctor and it was supported. As a result, he was found not guilty by virtue of mental illness. He was referred to the Ontario Review Board for further supports and supervision, but he avoided a criminal record and no further driving suspension.
