Cheng and Min married in China 4 years ago and have one child together. Cheng has been living in Canada for 10 years, while Min immigrated approximately one month prior to the incident involved.

On September 3rd, there was a verbal argument in which Min mentioned wanting to move back to China. Cheng hid her passport and cut up her permanent resident card, leading to a charge of mischief.

Approximately 2 weeks later, their child was crying. While looking for a toy in the dark to soothe the child, Min accidentally woke up Cheng, causing him to become upset, grab her by the neck, and push her against the wall. In an effort to defend herself, Min bit Cheng, and he bit her in response. This led to charges of assault strangulation assault causing bodily harm.

Approximately 2 weeks after the second incident, Cheng and Min were in a verbal argument while she was feeding their child. When he became frustrated at her lack of attention to him, Cheng threw a bowl of rice in Min’s direction, causing her to hide in the bathroom with their child and contact police. Cheng was charged with mischief for this incident.

Outcome: Cheng agreed to perform New Directions program upfront. He was a stellar student and received very high grades. The Crown was persuaded to agree to withdraw charges upon his entering into a peace bond.
