On the evening of February 8th, Emily attended a club on Clarence Street, consuming several alcoholic drinks over the course of the evening. After leaving the club, Emily drove her vehicle northbound until getting stuck in a snowbank in a dead-end street. A witness observed the driving behaviour and called 911.
Upon arriving at the scene, police observed Emily in the driver’s seat. She admitted to having a few drinks. While talking, police noted Emily had slurred speech and glossy eyes, and she was unsteady when stepping out of her vehicle. She was arrested for impaired operation. After being read her rights, she was transported to the police station, where she spoke with duty counsel. She provided two breath samples with readings of .212 and .204.
Emily was charged with operation while impaired, operation while impaired – blood alcohol concentration, and dangerous operation.
Result: There weren’t a lot of triable issues in this case, unfortunately. Emily made the difficult decision to plead guilty. She received a fine of $2000 and a one-year driving prohibition. She will be eligible to get her licence back after three further months of suspension so long as she uses a vehicle with the interlock device installed.
