The complainant, Ashley, had recently moved to the area. On a late July afternoon, she was smoking when Tom approached her while walking his dogs. After a brief conversation, Tom offered to show Ashley around town, which was accepted. After taking his dogs to his nearby home, Tom returned with his vehicle. During the drive, Tom is alleged to have inappropriately touched Ashley and offer money for sex. After multiple refusals, Tom returned to the original meeting point to drop off Ashley, who contacted police to file a complaint. Tom was charged with sexual assault.
Result: Ashley testified during a two day trial, during which issues regarding the reliability of her testimony were raised. Ultimately, Tom was acquitted.
